1. Agreement to Terms

By accessing or using Avocads ("the Service"), operated by Mushin Consulting LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Avocads is an AI-powered platform that enables users to generate static display advertisements. The Service uses artificial intelligence to analyze reference ads and generate new ad variations based on user-provided brand and product information.

3. Account Registration

To use the Service, you must:

• Create an account with a valid email address
• Be at least 18 years of age
• Provide accurate and complete information
• Be responsible for maintaining the security of your account credentials

4. Credits and Payments

The Service operates on a credit-based system. Credits are consumed when generating, editing, or extending images.

• Subscriptions: Monthly subscription plans provide a set number of credits per billing period. Subscription credits may expire according to plan terms.
• Top-up credits: One-time credit purchases that do not expire as long as your account remains active.
• No refunds: All purchases are final. Credits are not refundable. If you cancel your subscription, you retain access to remaining credits for 30 days.
• Failed generations: If a generation fails due to a system error, credits are automatically refunded to your account.

5. Acceptable Use

You agree not to:

• Upload content that infringes on third-party intellectual property rights
• Generate content that is illegal, harmful, threatening, abusive, or hateful
• Use the Service to create misleading or deceptive advertising
• Attempt to reverse-engineer, exploit, or abuse the AI generation system
• Share your account credentials or allow unauthorized access
• Use automated tools to access the Service beyond normal usage

6. Intellectual Property

• Your content: You retain ownership of images you upload and brand information you provide.
• Generated content: Images generated by the Service are provided for your commercial use. You are responsible for ensuring your use complies with applicable advertising laws and regulations.
• Our platform: The Service, including its design, code, and AI models, remains the property of Mushin Consulting LLC.

7. AI-Generated Content Disclaimer

Generated images are produced by artificial intelligence and may not always be perfect. We do not guarantee that generated content will be free from errors, suitable for any particular purpose, or compliant with specific advertising platform policies. You are solely responsible for reviewing and approving all generated content before use.

8. Limitation of Liability

To the maximum extent permitted by law, Mushin Consulting LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to factors beyond our control.

10. Termination

We reserve the right to suspend or terminate your account for violation of these terms. You may delete your account at any time by contacting support. Upon termination, your data will be deleted within 30 days.

11. Changes to Terms

We may update these terms from time to time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms shall be resolved in the courts of the state where Mushin Consulting LLC is registered.
